1. Agreement to Terms

By accessing or using SecuraPrep ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

SecuraPrep is an online platform providing interview preparation services for InfoSec, Cyber & GRC (Governance, Risk, and Compliance) stakeholders. Our services include:

• AI-powered interview simulations with video avatar technology
• Flashcard-based learning modules
• Scenario-based practice exercises with audio recording capabilities
• Framework and regulation study materials
• SecuraPrep Lingua knowledge base and terminology dictionary
• Interview prep video library with expert instruction
• 1:1 consultation services with industry experts
• Progress tracking, analytics, and gamification features
• AI-generated feedback and performance analysis

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.

You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Subscription and Payments

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly or annual basis, depending on the type of subscription plan you select.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or SecuraPrep cancels it. You may cancel your Subscription renewal through your online account management page or by contacting our customer support team.

A valid payment method, including credit card, is required to process the payment for your Subscription. You shall provide accurate and complete billing information. By submitting such payment information, you automatically authorize SecuraPrep to charge all Subscription fees incurred through your account.

5. Free Tier Access

SecuraPrep offers a Free tier that provides limited daily access to the platform's features. Free tier users can access:

• A set number of flashcards per day (content rotates daily)
• Limited scenario practice exercises per day
• Preview access to the SecuraPrep Lingua dictionary
• Limited training video access
• Preview of AI Interview Simulator features

No credit card is required to sign up for the Free tier. Users may upgrade to a paid subscription at any time to unlock unlimited access and additional features. SecuraPrep reserves the right to modify Free tier limits at any time.

6. Refund Policy

We offer a 30-day money-back guarantee for all new subscription purchases. If you are not satisfied with our Service within the first 30 days of your initial subscription, you may request a full refund by contacting our support team.

Refund requests made after the 30-day period will be evaluated on a case-by-case basis. Consultation service fees are non-refundable once the session has been completed.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of SecuraPrep and its licensors. The Service is protected by copyright, trademark, and other laws of both Ireland and foreign countries.

AI-generated content provided through our Service, including interview feedback, performance analyses, and study recommendations, is generated for your personal educational use. While you may use this content for your own interview preparation, SecuraPrep retains all rights to the underlying AI systems, algorithms, and methodologies used to generate such content.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of SecuraPrep. You may not copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of that software.

8. User Content

Our Service may allow you to post, link, store, share and otherwise make available certain information, text, audio recordings, video recordings, or data ("User Content"). You are responsible for the User Content that you post on or through the Service, including its legality, reliability, and appropriateness.

User Content includes but is not limited to:

• Interview session recordings (audio and video)
• Scenario response audio recordings
• Profile information and uploaded documents (CVs, job descriptions)
• Notes, comments, and feedback you provide

By posting User Content on or through the Service, you grant us the right to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content on and through the Service for the purpose of providing and improving our services. You retain ownership of your User Content.

9. Prohibited Uses

You agree not to use the Service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, national, or local regulations, rules, or laws
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others
• To harass, abuse, insult, harm, defame, slander, or discriminate against others
• To submit false or misleading information
• To upload or transmit viruses or any other type of malicious code
• To interfere with or circumvent the security features of the Service
• To share your account credentials with third parties or allow others to access your account
• To scrape, data-mine, or extract data from the Service for commercial purposes
• To attempt to reverse-engineer, decompile, or extract our AI models, algorithms, or systems
• To publicly share or distribute interview recordings without explicit consent from all parties
• To use AI-generated feedback to misrepresent your qualifications to employers
• To manipulate gamification systems or leaderboards through automated means

10. AI-Generated Content

SecuraPrep uses artificial intelligence technologies to provide interview simulations, feedback, and educational content. By using our Service, you acknowledge and agree that:

• AI-generated content is provided for educational and practice purposes only
• AI feedback is not a substitute for professional career advice or mentorship
• AI may occasionally produce inaccurate, incomplete, or outdated information
• Interview performance scores and feedback are estimates and do not guarantee actual interview outcomes
• SecuraPrep does not guarantee employment or successful interview results based on AI feedback

Our AI interviewer avatar ("Charlotte") and other AI-powered features use advanced language models and video synthesis technologies. These systems are designed to simulate realistic interview experiences but may not perfectly replicate human interviewer behavior or responses.

You should independently verify any factual information provided by AI systems, particularly regarding regulatory requirements, framework specifications, or industry standards.

11. Third-Party Services

SecuraPrep integrates with third-party services to provide certain features. By using our Service, you acknowledge that your data may be processed by these providers in accordance with their respective privacy policies:

• Video Avatar Technology: We use HeyGen for generating realistic AI interviewer avatars
• Voice Synthesis: We use ElevenLabs for natural text-to-speech and voice generation
• Payment Processing: We use Stripe for secure payment processing
• Authentication: We may use third-party authentication providers for account security

These third-party services have their own terms of service and privacy policies. While we carefully select our partners, SecuraPrep is not responsible for the practices or policies of third-party service providers.

12. Recordings and Media

Our Service includes features that allow you to record audio and video of your interview practice sessions. By using these features, you agree to the following:

• Consent: You consent to the recording and storage of your practice sessions
• Ownership: You retain ownership of your recordings, subject to our license to provide the Service
• Storage: Recordings are stored securely and accessible only to you and authorized SecuraPrep personnel
• Retention: Recordings are retained for as long as your account is active, unless you delete them
• Analysis: Recordings may be analyzed by AI systems to provide feedback and improve our services

We do not use your recordings to train AI models without your explicit opt-in consent. You may delete your recordings at any time through your account settings.

13. Consultation Services

SecuraPrep offers 1:1 consultation services with InfoSec, Cyber & GRC experts. The following terms apply specifically to consultation bookings:

• Cancellation Policy: Cancellations must be made at least 12 hours before the scheduled session to receive a refund or reschedule
• No-Shows: Failure to attend a scheduled session without prior cancellation forfeits the consultation fee
• Rescheduling: Sessions may be rescheduled once, subject to consultant availability
• Confidentiality: Consultants are expected to maintain confidentiality, but SecuraPrep cannot guarantee consultant behavior
• Platform Liability: SecuraPrep facilitates consultations but is not liable for advice provided by independent consultants

Consultation advice is for informational purposes only and should not be considered professional legal, financial, or career advice. You are responsible for your own career decisions.

14. Beta and Preview Features

SecuraPrep may offer features that are labeled as "Beta," "Preview," "Experimental," or "Coming Soon." By using these features, you agree that:

• Beta features are provided "as-is" without any warranties or guarantees
• Beta features may contain bugs, errors, or incomplete functionality
• Beta features may be modified, suspended, or discontinued at any time without notice
• There are no service level agreements (SLAs) for Beta features
• Data created in Beta features may not be preserved when the feature becomes generally available

We appreciate feedback on Beta features and may use your input to improve the Service. Participation in Beta programs does not entitle you to any compensation or continued access to the features.

15. Gamification and Virtual Rewards

SecuraPrep includes gamification features such as experience points (XP), achievements, badges, streaks, and leaderboards. By participating in these features, you agree that:

• Virtual rewards (XP, badges, achievements) have no monetary value and cannot be exchanged for cash or credit
• Leaderboard rankings may display your username or display name to other users
• SecuraPrep reserves the right to modify, reset, or remove gamification systems at any time
• Manipulation of gamification systems (automation, exploits) may result in account suspension
• Gamification progress is not transferable between accounts

You may opt out of leaderboard visibility through your account settings. Gamification features are designed to encourage learning and do not represent professional qualifications or certifications.

16. Age Requirements

You must be at least 16 years of age to use SecuraPrep. By creating an account, you represent and warrant that you are at least 16 years old.

If we discover that a user is under 16 years of age, we will immediately terminate their account and delete all associated personal data in accordance with applicable data protection laws.

Parents or guardians who believe their child has created an account should contact us immediately at support@securaprep.eu.

17. Account Termination

Termination by You: You may terminate your account at any time through your account settings or by contacting support. Upon termination:

• You will have 30 days to export your data (recordings, progress, notes) before permanent deletion
• Active subscriptions will not be refunded for partial billing periods unless required by law
• Your account data will be deleted in accordance with our Privacy Policy

Termination by SecuraPrep: We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or for other reasons at our discretion. In such cases:

• We will provide notice where possible and reasonable
• Refunds may be provided at our sole discretion, depending on circumstances
• You may request data export before account deletion, subject to verification

Termination does not affect any rights or obligations that accrued prior to termination.

18. Service Availability

We strive to provide reliable access to SecuraPrep, but we do not guarantee uninterrupted or error-free service. You acknowledge that:

• Maintenance: We may perform scheduled maintenance that temporarily interrupts service, typically with advance notice
• Uptime: We do not provide uptime guarantees or service level agreements for standard subscriptions
• Outages: Unplanned outages may occur due to technical issues, security incidents, or third-party service disruptions

Force Majeure: SecuraPrep is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, riots, government actions, power outages, telecommunications failures, or cyberattacks.

We will make reasonable efforts to restore service as quickly as possible during any disruption.

19. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

SecuraPrep does not guarantee that the use of our Service will result in employment or successful interview outcomes. Our materials are designed to assist with preparation but individual results may vary based on numerous factors outside our control.

20. Limitation of Liability

In no event shall SecuraPrep, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

21. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ireland.

22. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
